In most cases, however, franchisors do not offer or advise on health insurance and employee benefits and there is a good reason for this hands off approach.

Joint employer laws and their impact on franchising has been in the spotlight in recent years. Franchisors who exert control over a franchisee’s employees, in any manner, could be deemed a joint employer potentially making them liable for employees they don’t directly employ or manage. This essentially prevents a franchisor from organizing a group health plan for their franchisees while missing out on buying power that could reduce the cost of health insurance for franchisees and their employees.
